Tenreiro) заявил, что как сама компания, так и эмитенты криптоактивов и объективно мыслящие инвесторы должны были рассматривать предложение и продажу криптоактивов на платформе Cumberland как инвестиции в ценные бумаги. Cumberland получала прибыль от своей дилерской деятельности, не предоставляя инвесторам и рынку средства защиты, которые предусмотрены в рамках регистрации, уточнил Тенрейро.
«В криптоиндустрии возникает много протестов о том, что криптовалюты больше похожи на товары, чем на ценные бумаги. Однако согласно федеральным законам о ценных бумагах, все дилеры должны зарегистрироваться в SEC, и платформы, работающие на рынке криптоактивов, не исключение», — сказал Тенрейро.
В 2020 году SEC обвинила другую торговую платформу, Robinhood (NASDAQ:HOOD), в сокрытии информации от пользователей и обязала компанию выплатить штраф в $65 млн. В сентябре платформа Robinhood заключила мировое соглашение с калифорнийской прокуратурой, согласившись заплатить $3,9 млн за нарушение прав потребителей.
